A Visit To Madras High Court

Madras High court being one of the oldest Courts in India is situated in the heart of the city of chennai. We the final year students of Law college situated beside the Madras HC visited the court premises as a part of our academics. The first thing that I noticed was the buildings of the Courts were built.I was astound to see the structures of Court built in a well planned manner. The super strucutres are just amazing , though built hundreds of years ago.

We were directed by our Professor to observe the court proceedings. He explained us as to how to behave in court hall and observe the proceedings. At times he too joined us to watch the proceedings.

On the very first day we were assigned to observe the proceedings of IInd Assistant Court.Almost every case was passed over. But we were lucky enough to observe a fresh Interlocutory Application trial. After the trial, Judge interacted with us and explained how trials are heard and passed orders. The Judge was so down to earth that we learnt a lot. We can never forget Order 39 Rule 3 of CPC (IA) which was explained by the Judge.First day was quite interesting and the day winded for court visit.

The next day that is second day we were allotted to observe IIIrd Additional City Court proceedings.Cases were passed over i.e adjourned to next hearing.Next we went to observe IXth Additional Court. It is a CBI Court and we found the cases to be interesting when advocates argued.Though we were unable to listen very clearly of arguments, somehow we managed to take some notes as instructed by our Professor.

On the third day , I must mention that this Court is special as it was headed by Hon’ble Chief Justice Ghokale in the Ist Bench of High Court. In this court we were audible to hear the proceedings of court and were able to understand to an extent the nature of cases.I was observing the court proceedings and the interior decorations also . Courts built in those days are simple superb.

Today, the fourth day we were allotted to visit and observe Court Hall-15 headed by Justice . Jaichandaran and Bail court headed by Justice.Shivakumar. In court hall 15 miscellaneous cases were heard and passed over. But the arguments were quite interesting. After sometime we went to Bail court to watch how Bail orders were given. To give Bail order the cases are heard very keenly and only after analyzing, order is passed. Thus fourth day also winded with lot of interesting stuffs.

The last and final day, we were allotted to observe Court-11 presided by Justice.Prabha Sridevan and Justice.T.S.Sivagnanam.In this court miscellaneous petitions were heard and adjudicated. Many of the cases were passed over. Finally our court visit came to and end.

I could observe that the challenging job in the court was done by the advocates. As there are lot of pending cases,Judges main criteria is to dispose of them as soon as possible but the nature of cases do not allow so.Thus it would be necessary to increase the number of courts to dispose the pending cases .

Lower courts are not very strict unlike High Court where proceedings are done in pin drop silence. The cause list in the High Court is prepared for a week which allows the court to dispose of certain number of cases that are pending in for years and years. But in lower courts this is not a kind of practice i.e it is not prepared for a week.

We were inspired by the court proceedings and the challenging job of advocates. The very important stuff that we learn't were as how to behave in the court, with colleagues and the attitude to be built in .Thus Court visit was a great knowledgeable experience that drives us more deep into the noble profession.
